CONTEMPORARY CHALLENGES FACED BY WOMEN ON RAPE AND EXCERCISING HUMAN RIGHTS IN INDIA

Abstract: Rape is a heinous crime occurring around the country primarily with women of different ages. Women’s rights are human rights to be excercised from time to time. But, in our patriarchal society, women are treated as subordinate objects for men’s pleasure. This study focuses on the fact that what are the types of rape that women faces at various stages of their lives. Right from their birth covering puberty, youth till middle or old age no woman is spared. It is thus very important to view the study from a psychosocial perspective followed by legal perspective, different laws against rape, case laws that have taken place and the judgements by court. It is also important that we focus on the medicolegal perspective of the aforesaid crime. Rape happens due to a number of factors but in Indian society the girl or victim is blamed. This study provides a detailed study on how human rights of women in reference to the world is getting hampered and what our Indian Constitution is doing in terms of jurisdiction and legislation.
